Terms of Service

1. Quotations & Pricing

All quotations issued by Brandpack Ltd. are valid for 30 days unless otherwise stated.

Prices are subject to VAT where applicable and may be amended in the event of material cost increases, specification changes, artwork amendments, or customer-requested revisions after quotation.

2. Artwork & File Responsibility

Customers are solely responsible for ensuring all artwork, spelling, dimensions, dielines, barcodes, regulatory information, and print-ready files supplied to Brandpack Ltd. are correct prior to approval.

Approval of digital proofs, artwork previews, or production files constitutes full customer acceptance of the artwork for print.

Brandpack Ltd. shall not be liable for errors approved by the customer, including spelling errors, low-resolution artwork, incorrect dimensions, RGB to CMYK colour conversion, barcode issues, bleed or margin issues, font problems, overprint settings, or supplied dieline inaccuracies.

3. Colour Reproduction & Matching

Brandpack Ltd. does not offer colour matching services unless specifically agreed in writing prior to production.

All printing is processed using CMYK production methods unless otherwise specified. Colours displayed on screens, digital proofs, or RGB artwork may vary from the final printed result.

Variations may also occur due to differences in materials, laminations, coatings, print methods, inks, and production batches. Printed colours may vary between orders, reprints, and production runs.

Where colour accuracy is important, customers are strongly advised to request printed proofs or provide Pantone references for spot colour production where available.

Brandpack Ltd. shall not be liable for colour variations, perceived colour differences, or dissatisfaction relating to colour reproduction where artwork has been approved for print.

4. Production Tolerances

Due to the manufacturing nature of print and packaging production, reasonable industry tolerances apply.

Brandpack Ltd. reserves the right to deliver quantities within standard manufacturing tolerances of plus or minus 10% unless otherwise agreed in writing.

Minor variations in colour, cutting position, fold alignment, lamination, varnish registration, foil position, material thickness, creasing, finishing, and dimensions shall not constitute defects.

5. Lead Times & Delivery

Production and delivery timeframes are estimates only and are not guaranteed.

Lead times commence only once payment has cleared where applicable, final artwork has been approved, and all specifications have been confirmed.

Brandpack Ltd. shall not be liable for delays caused by courier services, customs processes, supplier delays, material shortages, machine breakdown, weather conditions, industrial action, force majeure events, or customer approval delays.

6. Courier Liability & Lost Deliveries

Risk in the goods passes to the customer upon dispatch from Brandpack Ltd.

Once dispatched, deliveries are carried out by third-party courier providers and are outside the direct control of Brandpack Ltd.

Where a parcel is delayed, missing, or marked as delivered but disputed by the customer, Brandpack Ltd. will assist by opening a trace or investigation with the courier.

Courier investigations may require time to complete before replacement, refund, or reprint decisions can be assessed.

Brandpack Ltd. shall not be liable for courier delays, failed delivery attempts, parcels left in designated safe places, incorrect delivery information supplied by the customer, consequential business losses, missed deadlines, or indirect financial losses arising from delayed or lost shipments.

7. Returns, Claims & Defects

Customers must inspect goods immediately upon receipt.

Any shortages, damages, or defects must be reported in writing within 3 working days of delivery.

No claims can be considered after goods have been used, processed, distributed, applied, or altered in any way.

Brandpack Ltd. reserves the right to request return of goods for inspection prior to agreeing any refund, replacement, or reprint.

Where a manufacturing defect is confirmed, Brandpack Ltd.''s liability shall be limited solely to replacement of the affected goods, partial refund, or reprint of the affected items at Brandpack Ltd.''s discretion.

8. Customer-Supplied Materials

Where customers supply materials, components, or products for printing or finishing, Brandpack Ltd. accepts no liability for damage during processing, print incompatibility, material failures, spoilage, or machine-related damage.

All customer-supplied items are processed entirely at the customer''s risk.

9. Intellectual Property

Customers warrant that they own or have permission to use all supplied artwork, trademarks, logos, designs, and intellectual property.

The customer shall indemnify Brandpack Ltd. against any claims, damages, or legal costs arising from copyright, trademark, or intellectual property disputes relating to supplied artwork.

10. Payment Terms

Goods remain the property of Brandpack Ltd. until paid for in full.

Brandpack Ltd. reserves the right to suspend production, dispatch, or future orders where accounts remain overdue.

Interest may be charged on overdue invoices in accordance with applicable Irish legislation.

11. Limitation of Liability

To the fullest extent permitted by law, Brandpack Ltd.''s total liability arising from any order shall not exceed the value of the goods supplied under that order.

Brandpack Ltd. shall not be liable for indirect losses, consequential losses, loss of profits, loss of business, reputational damage, customer production downtime, or third-party claims.

12. Force Majeure

Brandpack Ltd. shall not be liable for failure or delay in performance caused by events outside its reasonable control including natural disasters, fire, flood, war, cyber incidents, pandemics, power failures, supplier failures, transport disruption, or governmental restrictions.

13. Samples & Prototypes

Samples, mock-ups, prototypes, and previous production runs are indicative only and may not exactly represent final production output.

Minor variations between samples and final production shall not constitute defects.

14. Storage & Uncollected Goods

Brandpack Ltd. reserves the right to charge storage fees for goods not collected or dispatched within 14 days of completion unless otherwise agreed.
